The following Privacy Policy ("Policy") summarizes the various ways that Sensibill Inc. uses the information you provide to us or we gather from you while you access or use the Sensibill beta mobile application ("App" or “Services”). It is our goal to provide you with information that is tailored to your individual needs and, at the same time, respect your privacy.

Please read this Policy carefully. Your access to or use of any part of the Services will constitute your notice about our collection, use, and disclosure of your information in accordance with this Policy. If you do not wish for us to collect, use, and disclose your information in accordance with this Policy, please do not access or use the Services. This Policy does not cover information collected elsewhere, including, without limitation, offline or on sites linked to or through the Services. We may add to or amend this Policy with other notices. We may also post different privacy statements for some Services, and when we do so, this Policy does not apply. For example, separate policies and terms apply to information collected through our getsensibill.com site and platform or our other mobile applications.

This Policy applies solely to information collected by us through the Services and does not apply to any third-party activities, including third-party websites linked from our Services, third-party social networking platforms or features we make available through our Services, or third-party ads displayed on our Services. We are not responsible for the privacy practices or content of such third parties. We encourage you to read the privacy statements of those third parties.

  1. WHAT INFORMATION WE COLLECT FROM YOU

    When you register with Sensibill or use the Services, we ask for your email address and password and name.

    Information We Automatically Collect About Visits and Usage:

    For all App users, not just registered users, we collect information such as IP address, device identifier, browser type, device type, domain name, access times, duration of visit, referring URL, platform, new and repeat information, time stamp, exit page information, and other information about how you use the Service. We use analytics, including analytics conducted by third-party services, to help analyze how users use the Services. To do this, we and our third-party service providers use cookies (unique identifiers sent to your computer by a Web server and stored on your computer’s hard drive) and scripts to collect and store information such as how users interact with our Services, errors users encounter when using our Services, device identifiers, how often and for how long users visit and use the Services, and which pages they visit on our Services. We use this information to improve our Services and your user experience.

  2. EMAIL AUTO-IMPORT

    You may associate your email accounts with the Service by providing us with log-in credentials for your email accounts. Once you have authorized us to do so by associating your accounts, we will use our automated technology to regularly review the contents of emails in your email accounts to look for receipts and transaction-related emails, including those with information about product shipping confirmations reward-program statements, and retail marketing offers. This information collected from your emails will be added to your Sensibill account so that you may automatically access this information on the Service and so that we may use this information for other purposes described in this Policy.

  3. LOCATION DATA

    We may collect geolocation data through our Services. We may use this information as described in this Policy, including, for example, to provide you with offers or opportunities based upon your location and travel plans.

    The Services allow Users to receive and store digital purchase receipts, digital return receipts, gift receipts and other digital transaction records. The Service is designed to automate and streamline the receipt of digital receipts and to facilitate the return or exchange of the products and services described in those digital receipts. The Service is also designed to make the use and exchange of gift certificates and receipts more efficient. Additionally, the Service allows the merchants with whom You deal to make product and service offers to You based on Your purchasing activity as tracked by the Service. Finally, the Service provides various fraud prevention tools designed to make Your purchase and return activities safer. You acknowledge and agree that all transactions facilitated using the Service will be strictly between the You and the applicable merchant with whom You are dealing and while Sensibill will assist in the delivery and storage of digital transaction records that may be issued by the applicable merchant, Sensibill is not a participant in Your transaction. Sensibill may alter, suspend, or discontinue the Service at any time and for any reason or for no reason, although prior to permanently discontinuing or closing the Service, Sensibill will provide a thirty (30) day period during which Users can download copies of their digital transaction records. The Service may be unavailable from time to time due to maintenance or malfunction of computer or network equipment or other reasons. The Service may be updated periodically and feature(s), information or capabilities may be added, deleted or altered without notice. You shall not resell the Service, the use of the Service, or access to the Service. You acknowledge and agree that the Service will be provided with advertisements and merchant offers that will be presented to You as messages or offers in Your Service account and that the presentation of these messages and offers to You is necessary to enable Sensibill to provide the Service. You also acknowledge and agree that Sensibill may send certain communications to You, including Service-related announcements, administrative messages, and other communications, and that these messages are part of the Service and You may not elect to not receive them. If You elect to have any business dealings with anyone whose products or services may be advertised or offered through the Service, You acknowledge and agree that such dealings are solely between You and such advertiser and You further acknowledge and agree that Sensibill shall not have any responsibility or liability for any losses or damages that You may incur as a result of any such dealings. You shall be responsible for obtaining access to the Service and acknowledge that such access may involve third-party fees (such as telecommunications or Internet service provider access or data plan fees). You shall be solely responsible for any such fees and also for obtaining any equipment required to access the website and/or the Service. It is solely Your responsibility to ascertain whether any information or materials downloaded from the Service are free of viruses, worms, Trojan Horses or other malicious code.

  4. HOW YOUR INFORMATION IS USED

    In addition to the uses described in this policy, we may use personal information about you to create and manage your transaction histories and your purchase receipts, send you marketing messages about our Services, and otherwise provide you with and improve the Services. We also use the information that we gather to personalize and customize experience, content, marketing, and recommendations across all our Services, including to target content on our Services to more closely match your interests and, if you have selected to receive email communication from us, target email marketing messages that are more appropriate to your needs. We may use your personal information to respond to your comments and questions and provide customer service; send you information related to your requests and purchases, including confirmations, invoices, technical notices, updates, security alerts, and support and administrative messages; communicate with you about contests, promotions, rewards, upcoming events, and process and deliver contest entries and rewards; link or combine your personal information with other information we get about your use of other Services and from third parties to help understand you and your needs, and provide you with recommendations, better service, and customized marketing; and protect, investigate, and deter against fraudulent, unauthorized, or illegal activity.

  5. HOW YOUR INFORMATION IS PROTECTED

    We maintain data handling and storage practices and procedures that are designed to promote the integrity and confidentiality of the personally identifiable information. No method of transmission over the Internet or method of electronic storage is 100% secure, however. Therefore, while we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security.

  6. HOW YOUR INFORMATION IS DISCLOSED

When you use the Service, your personal information and your transaction information will be disclosed to the third parties you designate for access to such information, including other companies, websites, mobile applications, your friends, relatives, and business associates. Depending upon the type of access you grant to such third parties, they may also be permitted to edit the information you have provided to us and to designate others to access and edit such information.

Information we may disclose

  • When we believe it is appropriate to investigate, prevent, or take action regarding illegal or suspected illegal activities; to protect and defend the rights, property, or safety of Sensibill, our users, or others; and in connection with the enforcement of our terms, contracts, and User Agreement.

  • In connection with a corporate transaction, such as a divestiture, merger, acquisition, consolidation, or asset sale (or the negotiation thereof), or in the unlikely event of bankruptcy. We may assign or transfer your information as part of the transaction.

  • With third-party business firms contracted to provide specific services to us, such as a credit card processing company, email messaging providers, SMS providers, and other third parties that perform services on our behalf as a part of the Service.

  • As required by law and when we believe that disclosure is necessary to protect our rights and/or comply with a judicial proceeding, court order, or legal process served on our Site.

From time to time, we also may disclose general information about our Services, users, and visitors such as the number of visitors, aggregate and/or non-personally identifiable demographic and transaction data, etc., with third parties (including with your employer, if your account was provided through your employer).

We may also post customer feedback on our website from time to time along with your first name and last initial.

  1. WHAT CHOICES ARE AVAILABLE TO YOU ON OUR SERVICES

    We think that you benefit from a more personalized experience when we know more about you and your experiences with the Services. However, in some cases you can limit the information you provide to us, and you can limit the communications that we send to you. Registration is optional. If you choose not to register, certain features of the Service may be inaccessible. Registration and log-in are required to access your transaction history and receipts using our Service. In the Settings section, you may make changes to or delete inaccuracies in your account and change your password, privacy settings, or contact information such as your name, email address, etc. We will retain your information for as long as your account is active or as needed to provide you the Service and as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.   2. INTERNATIONAL USERS APPLICABLE LAW

    Please note that the personal information you submit to our Service will be transferred to Canada and other countries to be processed by us in order to provide the Service to you or for such other purposes as set forth in this Privacy Policy. If you are not a resident of Canada, you acknowledge and agree that we may collect, process, use, and store your personal information, as discussed in this Privacy Policy, outside your resident jurisdiction, including in Canada. Please be aware that Canadian law and laws of other countries where we may store and process your data may offer different levels of protection for personal information than may be available in your country. Sensibill is a Canadian corporation and complies with the Personal Information Protection and Electronic Documents Act (PIPEDA) regarding the collection, use, and retention of personal data.   5. CALIFORNIA PRIVACY NOTICE

Right to know. You have a right to know what personal information Sensibill has collected about you, including the categories of personal information, the categories of sources from which the personal information is collected, the business or commercial purpose for collecting, selling, or sharing personal information, the categories of third parties to whom Sensibill discloses personal information, and the specific pieces of personal information Sensibill has collected about you.

Right to access. You have the right to request the specific pieces of personal information Sensibill has collected about you.

Right to delete. You have the right to delete personal information that Sensibill has collected from you, subject to certain exceptions.

Right to correct. You have the right to correct inaccurate personal information that Sensibill maintains about you.

Right to opt-out. If Sensibill sells or shares personal information, you have the right to opt-out of the sale or sharing of your personal information by Sensibill. However, Sensibill does not sell your personal information.

Right to limit use of sensitive information. If Sensibill uses or discloses “sensitive personal information” (as defined in the CCPA) for certain purposes, you have the right to limit the use or disclosure of sensitive personal information by Sensibill. However, Sensibill does not collect your sensitive personal information.

Right to not receive discriminatory treatment. You have the right not to receive discriminatory treatment by Sensibill for the exercise of privacy rights conferred by the CCPA.

How to Exercise Your Rights. 

If you would like to exercise your right to know, right to access, right to delete, or right to correct, you may make a request by contacting us through the form here, or by calling 1-833-444-3469. If requested by e-mail, in your message, please indicate the right you would like to exercise and the personal information that you would like to know, access, delete, or correct.

You may opt out of Sensibill “selling” your personal information (although Sensibill does not sell your personal information) and “sharing” of your personal information for purposes of online analytics and advertising by contacting us through the form here.

If you use an authorized agent to submit a request to know, access, delete, or correct your personal information, we require that you verify your own identity directly with Sensibill and directly confirm with Sensibill that you provided the authorized agent permission to submit the request.

We may ask you for additional information to confirm your identity and for security purposes before processing your request. We reserve the right to charge a fee where permitted by law, for instance if your request is manifestly unfounded or excessive.

We may not always be able to fully address your request, for example if it would affect the duty of confidentiality we owe to others or if we are legally entitled to deal with the request in a different way.

Retention of your personal information

We retain your personal information for as long as necessary to fulfill the purposes described in this California Privacy Notice and/or our business purposes, or as required by law, regulation, or internal policy. We will delete or de-identify information when it is no longer needed to fulfill these purposes unless a longer retention period is required to comply with applicable laws.

Children Under 16

Our Site is intended for general audiences and is not directed at children. If we discover that a child under the age of 16 (or such other appliable age of consent for privacy purposes in relevant individual jurisdictions) has provided us with personal information, we will delete such information from our systems. If there is any data that we are unable, for technical reasons, to delete entirely from our systems, we will implement appropriate measures to prevent any use of such data.
